Argentina has recently emerged as a key player in the global and regional movement to regulate the development and use of Artificial Intelligence (AI). The regulation of AI has become a central topic in legislative debates, reflecting a growing bipartisan consensus on the need for effective governance in this area.

Legislative Activity on AI Regulation

  • In 2024 alone, 19 AI-related bills were introduced in the Argentine Congress, a notably high number in comparison to typical legislative activity.

  • Over the course of recent years, 28 bills related to AI have been presented across both the House of Representatives and the Senate.

Key Developments in Legislative and Government Action

  • The Science, Technology, and Productive Innovation Committee of the House of Representatives has been actively involved in discussions on AI, holding four informational meetings with experts and stakeholders in the field. In the session held on October 8th, 2024, the committee chairman emphasized the importance of crafting a regulation suited to Argentina’s unique needs rather than blindly adopting foreign frameworks.

  • In 2023, the previous administration issued a set of Recommendations for the Use of AI, which were published on the government’s official website. These recommendations provide initial guidance on the ethical use of AI but are not yet formal regulations.

  • In September 2024, the Agency for Access to Public Information released a comprehensive guide on the responsible use of AI, which addresses fundamental principles such as human rights, non-discrimination, transparency, privacy protection, and accountability in the development and deployment of AI systems.

  • Importantly, the guide includes a right to human review, which grants individuals the ability to request a human examination of decisions made by automated or semi-automated systems that affect their personal, professional, or economic interests. While this document does not constitute binding regulation, it lays a foundational framework for future, more formal AI governance in Argentina.

  • As these developments suggest, Argentina is increasingly recognizing the need to balance innovation with ethical considerations in AI, and is positioning itself to create a robust regulatory framework tailored to its unique national context.
